Theodore Arsenault
Since graduating from Dalhousie Law School in 1979, Theo has earned 40 years of experience in the legal profession. As senior counsel, Theo’s wide range of legal talents add real value to the firm’s ability to handle our client’s challenging legal issues. David M. Aaron
David Aaron graduated with his LL.B degree in 2001 with a combined degree from the University of Victoria, with the Law Foundation Scholar distinction, and the University of Ottawa. David was called to the Ontario Bar in 2002 and to the British Columbia Bar in 2003. As a practicing lawyer, David has 18 years experience in advocating for, and representing in tribunals and courts, citizen’s groups, trade unions, class action plaintiffs, aboriginal rights and environmental interests.
David has successfully defended privacy law rights in the high-tech context. In collaboration with the industry employers’ association and the firm’s trade union construction clients, David played a key role in brokering B.C.’s first industry-wide drug testing policy for the unionized construction industry. David was the Plaintiff counsel on B.C.’s first certified environmental class action.
In recognition of David’s expertise in the above areas, David has presented at numerous legal conferences on the issues of employee privacy rights and drug testing.
David contributes a creative and innovative edge to the firm’s successful representation of its clients.
Outside the office, David enjoys spending time with his family, playing music and travelling.

Ben Arsenault
Ben was called to the Bar in British Columbia in 2015. Ben has a Juris Doctorate (Bachelor of Law) from the University of Victoria, and a Bachelor of Arts from McGill University.
Ben’s practice focusses on all aspects of labour and employment law. He regularly represents union clients in arbitrations over Collective Agreement disputes and discipline grievances. He has appeared on behalf of unions before the BC Labour Board on common employer and certification applications, as well as internal union disciplinary matters. In the area of human rights, Ben has experience defending unions and non-profit organizations at the BC Human Rights Tribunal. For non-union employees, Ben has negotiated wrongful dismissal settlements. Ben also has experience in judicial reviews before the Federal Court and the BC Supreme Court and Court of Appeal where he has successfully argued for the protection of union members’ privacy rights and retained members’ security permits to work in federally regulated job-sites.
Ben’s advocacy on behalf of his clients is marked by careful attention. The focus is on restoring the balance to the workplace and the lives of his clients with integrity and respect for the central role that his clients’ working relationships play in their lives.
Ben is a musician, and regularly records and plays shows on his own and with his band, Real Ponchos. He loves the wilderness and is an avid skier, sailor and backcountry hiker.
